Recent Cases

During 2005 the U.S. Supreme Court made two important decisions affecting HR issues. In IBP, Inc. v. Alvarez, et al., the Court held that employees must be compensated under the FLSA for time involved in donning and doffing specialized protective gear. On the subject of employment discrimination, the Court held that recovery for disparate impact discrimination was allowed, under the Age Discrimination in Employment Act on a similar basis as that permitted under the Civil Rights Act of 1964. Both cases are covered in this revision.
